Waters of the United States (WOTUS) takes effect today in Illinois - from Teresa Steckler

In the courts, two of the three federal district court judges in Georgia and West Virginia refused to block WOTUS from taking effect. One of the cases was brought by a coal company, the other by a group of 12 states. A third federal court judge in North Dakota issued a preliminary injunction blocking implementation of WOTUS in 13 states west of the Mississippi. In his ruling, Judge Ralph Erickson said his review of internal agency documents "reveals a process that is inexplicable, arbitrary, and devoid of a reasoned process." EPA and the Corps insist that any legal challenges to WOTUS be heard in the DC Court of Appeals, not in federal district court. As for Illinois and the rest of the country, EPA announced "the rule is effective August 28."
