Split Ownership of Timber (IL)

My sister and I own majority interest of 40 acres M/L in Illinois. A timber harvester in Illinois wants to selectively harvest timber on our land. We want to sell them our share of the timber to be harvested. I own 50% and my sister owns 25%. Until her death, our aunt owned the remaining 25%. Crawford County records still list our aunt as the owner of the remaining 25%. Obviously, someone else owns it now. Crawford County does not know and the trustee refuses to tell us. Under these circumstances, how can we sell our share of the timber? Does the State of Illinois have a procedure to deal with this situation? We appreciate your assistance and hope there is a solution to this dilemma. Thank you. Mary Brown

Hi Mary:

Excellent question! However, I am not an attorney and this is most definitely a legal question.

Please contact a local attorney for an answer to your question(s)!

Best of luck!
