Deer Nuisance permits for Plasticulture strawberry

I recently called about a nuisance permit for my deer problem in plasticulture strawberries. I was told by the wildlife biologist that my 4 acres of strawberries isn't big enough to qualify for a nuisance permit???? Four acres is a considerably sized strawberry farm and I don't understand his reasoning.
